My Personal Somm Terms of Use
Last updated: November 5, 2026
1. Who provides the App; how these terms fit together
My Personal Somm (the “App”) and its related wine-discovery services are provided by Davidson Hospitality, LLC, doing business as Vine Society (“we,” “us,” or “Vine Society”). These App Terms govern your use of the App and its related services. By using the App after these terms are presented to you, you agree to them. If you do not agree, do not use the App.
The Website Terms of Use at https://www.vinesociety.com/site-terms-of-use continue to apply to the website. These App Terms apply specifically to the App; they do not change the terms for website orders, events, or travel. The website Store Policy and Event & Cancellation Policy do not govern digital App subscriptions or search-credit purchases. Section 5 below governs those purchases, subject to the purchasing store's applicable terms and mandatory law. These App Terms control over any conflicting general website provision for App services, but do not override mandatory consumer rights or the Apple software-license terms described in section 10.
2. Adults only; responsible enjoyment
You must be at least 21 years old, and meet any higher legal drinking age applicable where you use the App. Do not misrepresent your age, help minors obtain alcohol, or use the App to promote underage or excessive drinking. An app store's content age rating is not permission to drink or purchase alcohol and does not replace this eligibility rule. Follow local alcohol laws. Never drink and drive or use the App while driving. Do not consume alcohol when medically advised not to do so.
3. Wine discovery and AI limitations
The App provides AI-assisted wine information, food-pairing suggestions, text and photo searches, retailer discovery, favorites, notes, search history, and technical-sheet exports. Features and results depend on the App version and available information.
AI-generated information can be inaccurate, incomplete, outdated, or misleading, even when it sounds confident. Independently verify important details, including the identity and vintage of a bottle, producer information, ratings, drinking windows, estimated values, retailer details, prices, and availability. An estimated value is not an appraisal, investment recommendation, or guarantee of resale value. A retailer result is not a guarantee that a particular bottle is stocked or that a transaction can legally be completed.
Recommendations and technical sheets are for general education and enjoyment, not medical, nutritional, allergy, or other professional advice. Do not rely on them to determine allergens, sulfites, ingredients, dietary suitability, medication interactions, pregnancy safety, or whether alcohol is safe for you. Read the actual product label and consult the producer, retailer, or an appropriate qualified professional. AI output is not necessarily a statement or endorsement by a human sommelier. These explanations do not excuse us from responsibilities that cannot lawfully be excluded.
4. Accounts and your material
Provide accurate account information, safeguard your login, and tell us promptly about suspected unauthorized access. Do not impersonate another person or access an account without authorization. You remain responsible for your own misuse of the App; nothing here makes you liable for unauthorized activity to the extent the law provides otherwise.
You retain the rights you have in the notes, photographs, prompts, and other material you submit. Submit only material you have the right to use, and do not include another person's private information without authorization. You give us only the permissions reasonably necessary to process your submissions and provide the App functions you request, consistently with the applicable privacy notice and any required separate consent. This is not permission to sell your personal information, use your private notes in advertising, or publish your submissions without authorization.
The website's permission to display website comments and reviews does not grant permission to publicly display private App material. If you choose to export or share a technical sheet or other material, check its accuracy and make sure you have the necessary rights before sharing it. Third-party materials and trademarks remain subject to their owners' rights; AI generation does not guarantee that output is unique, copyrightable, or free of third-party rights.
5. Optional purchases, Premium, and search credits
The App is free to download. Premium and additional search-credit packs are optional paid in-app purchases, not purchases of wine or event tickets. The applicable store's purchase screen identifies the product, price, currency, billing period, and applicable offer terms before you confirm a purchase. Prices may vary by store, territory, taxes, and offer. Check the actual purchase screen; a price quoted elsewhere is not a promise of a universal price.
Premium is an automatically renewing monthly subscription that includes 50 searches per monthly billing cycle. The monthly subscription allowance resets on renewal and unused monthly searches do not roll over. Separately purchased packs provide 10, 25, or 50 additional search credits and do not expire; they are distinct from the monthly subscription allowance. Search credits provide App searches, not cash or rights to buy alcohol.
Apple purchases. Payment is charged to your Apple Account at confirmation. Premium automatically renews unless canceled at least 24 hours before the current subscription period ends. Your account is charged for renewal within 24 hours before the end of that period. Manage or cancel through your Apple Account subscription settings.
Google Play purchases. Premium automatically renews each month unless canceled through your Google Play subscription settings. Manage or cancel through Google Play's subscription-management service. Your store's confirmation and subscription settings show the applicable billing and renewal information.
Canceling ordinarily stops the next renewal, while access continues through the period already paid for, subject to the store's rules and any applicable immediate-cancellation or refund rights. Uninstalling the App is not subscription cancellation. Requesting account deletion should not be relied on to stop store billing: also manage your subscription with the store where you purchased it, or contact us for help.
Refunds, withdrawal rights, disputed charges, and purchase remedies are governed by applicable law and the purchasing store's applicable procedures. Request store-billed refunds through that store's refund process; you may also contact us for help with undelivered or faulty App services. These terms do not impose a blanket “no refunds” rule or exclude any remedy required by law. Changes to subscription pricing or purchase terms are subject to the store's notice and consent requirements and applicable law; posting revised website terms alone does not authorize a new charge.
6. Acceptable use and reporting concerns
Do not use the App or its AI features to create, request, upload, or distribute unlawful or harmful material. Prohibited conduct includes child sexual exploitation or abuse; non-consensual sexual material; threats, harassment, hateful or discriminatory abuse; scams, impersonation, or deceptive claims; infringement of intellectual-property or privacy rights; malware, unauthorized access, or interference with security; and encouragement of dangerous, underage, or excessive alcohol consumption. Do not bypass safety controls, purchase controls, age restrictions, or usage limits.
You may report harmful content, suspected infringement, safety concerns, or abuse to info@vinesociety.com, identifying the App and the relevant content or issue. Do not send passwords or full payment-card details. This contact route is available in addition to reporting tools provided in the App; it does not replace any reporting functionality required by an app store.
We may restrict access or remove material when reasonably necessary to address a violation, fraud, a security risk, or a legal obligation. Any restriction remains subject to applicable law and rights concerning paid services; this is not an unrestricted right to confiscate paid entitlements.
7. Privacy, permissions, and account requests
The App privacy notice linked within the App and its store listings explains personal-information practices and account/data requests. The website Privacy Policy separately addresses the website and shop. These App Terms do not amend either privacy notice, create a new data-retention schedule, or substitute for disclosures, device permissions, or separate consent required for data processing or sharing with third-party AI services.
For help with your My Personal Somm account or a request to delete your account and associated personal information, contact info@vinesociety.com, identifying My Personal Somm and the account concerned. This repeats the request route in the App privacy notice; it does not replace required in-app deletion controls or change the deletion and retention practices described there. Subscription cancellation and account/data deletion are distinct requests. Contact us if you need help with either.
8. Retailers, links, and intellectual property
The App may link to third-party retailers and other services. Their applicable terms govern your dealings with them. Verify price, availability, licensing, age requirements, shipping eligibility, and any purchase terms directly with the seller. No App subscription or search purchase is an order for alcohol, a retail discount, or permission to purchase alcohol where prohibited.
Our software, branding, and original App content belong to us or our licensors. Subject to the applicable software license, you may use the App and its ordinary saving, printing, and sharing features for lawful personal use. Do not resell the App, misuse its content, or copy, scrape, reverse-engineer, or interfere with the software except as applicable law, an applicable open-source license, or the governing software license permits. Comply with applicable third-party agreements, including your device, network, and app-store terms. Third-party involvement does not waive our own legal responsibilities.
9. Availability, warranties, and mandatory rights
Internet access and a supported device and App version may be needed. We may maintain or update the service or reasonably restrict features for security, legal, or operational reasons. We do not promise uninterrupted availability or error-free AI results. Any material change affecting an existing paid entitlement remains subject to applicable notice, consumer-protection, and refund requirements.
To the extent permitted by law, the App services and informational content are provided “as is” and “as available,” without guarantees of accuracy or fitness for a particular purpose. To the extent permitted by law, we are not liable for indirect or incidental losses caused by use of the App services. Nothing in these terms excludes mandatory warranties, statutory consumer remedies, liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.
10. Apple and Android software-license terms
Apple App Store. Apple's Licensed Application End User License Agreement (“Standard EULA”), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, governs the software license for the App obtained through Apple unless a valid custom EULA is expressly supplied through the App Store for your territory. These App Terms supplement the App services; they are not a replacement custom EULA and do not narrow the usage rights or protections provided by the applicable Apple license or Apple Media Services Usage Rules. The Standard EULA governs a conflict concerning the Apple software license. Apple is not the provider of Vine Society's wine-discovery service and does not endorse its recommendations. Contact us for App support and complaints.
Android. Subject to these terms and applicable Google Play terms, we grant you a limited, non-exclusive, non-transferable license to install and use the App on compatible Android devices you own or control for lawful personal use. Rights required by applicable law and applicable open-source licenses are preserved. Google is not the provider of Vine Society's wine-discovery service and does not endorse its recommendations.
11. Changes, law, and contact
North Carolina law governs these App Terms, subject to mandatory protections and rights under the laws applicable to you. This does not impose an exclusive court venue or displace the governing software license's provisions.
We may update these App Terms by posting a revised version with a new date and providing any additional notice or consent required by law. Changes apply prospectively, not to remove accrued rights or authorize charges without the required purchase authorization. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
